Terms of Service

These Terms govern your use of Jackd Rabbit (jackd-rabbit.app), operated by Blue Blip Tech LLC ("we", "us"). By creating an account or using the service, you agree to these Terms and to our Privacy Policy.

1. Health and safety

Jackd Rabbit provides general fitness information, including AI-generated workout suggestions and automated form feedback. It is not medical advice and does not replace a doctor, physiotherapist or qualified trainer. Consult a healthcare professional before starting a new exercise program, especially if you have a medical condition or injury. Stop exercising if you feel pain, dizziness or shortness of breath.

AI suggestions and form feedback can be wrong or incomplete. You exercise at your own risk and are responsible for choosing loads and movements that are safe for you.

2. Eligibility and accounts

You must be at least 13 years old, and old enough to form a binding contract where you live, to use Jackd Rabbit. You must provide accurate information, keep your password confidential and tell us promptly about any unauthorized use of your account. You are responsible for activity under your account.

3. Free trial and subscriptions

• New accounts start with a free trial that has usage limits. Features and limits are described on the Pricing page.
• Paid subscriptions are billed in advance each billing period through Stripe and renew automatically until cancelled.
• You can cancel at any time from your account. Cancellation stops future charges; fees already paid are non-refundable except where required by law.
• If a payment fails, we may give a short grace period and then limit paid features until payment succeeds.
• We may change prices with advance notice. Changes apply from your next billing period.

4. Acceptable use

You agree not to:

• break the law or infringe anyone's rights while using the service;
• try to access other users' accounts or data, or probe, scan or disrupt the service;
• scrape, copy or redistribute the exercise library, images or animations;
• use automated tools to create accounts or get around usage limits;
• resell or sublicense access to the service.

5. Content and intellectual property

You keep ownership of the workouts, plans and other data you enter, and you let us use it to provide the service to you. The service itself, including its software, design and exercise content, belongs to us or our licensors and is licensed to you only for personal, non-commercial use while your account is active. Third-party credits are listed on the Credits page.

6. Third-party services

Some features rely on third parties, including embedded YouTube videos. Their content and terms are their own, and we are not responsible for them.

7. Termination

You can delete your account at any time from Account settings. We may suspend or close accounts that violate these Terms or put the service or other users at risk.

8. Disclaimers

The service is provided "as is" and "as available". To the fullest extent permitted by law, we disclaim all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose and non-infringement. We do not guarantee that the service will be uninterrupted, error-free, or that it will produce any particular fitness result.

9. Limitation of liability

To the fullest extent permitted by law, Blue Blip Tech LLC is not liable for any indirect, incidental, special, consequential or punitive damages, or for any injury arising from exercises you perform. Our total liability for any claim relating to the service is limited to the amount you paid us in the 12 months before the claim arose.

10. Indemnity

You agree to indemnify Blue Blip Tech LLC against claims arising from your misuse of the service or your violation of these Terms.

11. Governing law

These Terms are governed by the laws of the State of Georgia, United States, without regard to its conflict of law rules. Any dispute will be resolved in the state or federal courts located in Georgia, and you and we consent to their jurisdiction.

12. Changes

We may update these Terms. If a change is material, we will update the effective date and notify you by email or in the app. Continuing to use the service after that means you accept the updated Terms.
